What is an accident claim?
Accident – or personal injury claims – are claims for compensation made for accidents resulting in injuries or even fatalities caused by someone else.
It could be an accident at work; an accident in a public place like a supermarket; a trip for slip on a pavement; or a road traffic accident. More broadly it can apply to industrial disease which is an illness or condition caused by exposure to harmful substances or unsafe conditions in the workplace – or clinical or medical negligence where you suffer injury or harm, due a mistake by a medical professional.
How long do I have to make a claim?
If you are over 18 years old and your accident happened in the UK you have 3 years from the date of the accident in which to make a claim for compensation.
If you are under 18 years old you have 3 years from the date of your 18th birthday in which to make a claim for compensation. Don’t delay, the sooner you make a claim the more chance you have of being successful.
What is a “no win no fee” agreement?
A “no win no fee” agreement (or a conditional fee agreement) is regularly used in accident claims. If you do not have any other source of funding such as legal expenses insurance or through a trade union – it is usually the best way of funding a claim.
A “No Win No Fee" agreement provides that if you do not win your case, you will not have to pay your own legal fee- but if you win, you will pay a success fee (typically capped at 25% of your damages).
It’s usually wise to take out an after the event insurance policy to back up the agreement to ensure that any other expenses, apart from your legal fees, are also covered.
How much is my accident claim worth?
